Terms of Service

Who I am

This website and the services offered through it are provided by Jason Krahn, an independent software developer based in Dufresne, Manitoba, Canada ("Jason Krahn", "I", "me"). By contacting me about, or purchasing, any service, you agree to these Terms of Service.

Services

I provide custom software development, ongoing ("continuous development") services, and product/UX consulting for business clients. The specific scope, deliverables, and price for each engagement are agreed in writing (by email or a written agreement) before work begins.

Monthly plans and billing

• Monthly continuous development plans start at $650 CAD per month, plus GST where applicable. Your confirmed plan price is the amount stated in our written agreement or invoice.
• Monthly plans are billed in advance for each monthly period. The billing period starts on the day your first payment is made and renews on the same day each following month.
• Payments are collected by pre-authorized debit (PAD) from a Canadian bank or credit union account, processed by Stripe. By starting a monthly plan you authorize recurring debits until the plan is cancelled.
• Plan prices may change with at least 30 days' written notice. A price change never applies to a period already paid.
• If a payment fails, I will notify you and retry or re-invoice; services may be paused while an amount remains outstanding.

Cancellation

You may cancel a monthly plan at any time by emailing jasonkrahn@gmail.com. Cancellation takes effect at the end of the current billing period and no further charges will be made. The full policy is in the Refund & Cancellation Policy.

Project work

Fixed-scope project work is quoted individually. Any deposit terms, milestones, and delivery timelines for a project are set out in the written quote or agreement for that project, which prevails over these general terms if there is a conflict.

Intellectual property

On receipt of full payment, you own the deliverables created specifically for you under an engagement. I retain ownership of my pre-existing code, tools, libraries, and know-how, and a licence to use them in my other work.

Warranties and liability

Services are provided with reasonable skill and care. To the maximum extent permitted by law, my total liability arising from any engagement is limited to the amounts you paid for the relevant service in the three months before the claim, and I am not liable for indirect or consequential losses.

Governing law

These terms are governed by the laws of the Province of Manitoba and the applicable laws of Canada.
